1. Introduction:
- Be Comfy offers various home energy assessment and reporting Services (referred to as “Services”), including Phone Consults, Basic Home Assessments, Residential Efficiency Scorecard Assessments and Detailed Reporting.
- Be Comfy (referred to as Be Comfy or "Consultant") agrees to provide Services to the client (referred to as "Client") according to the terms outlined below.
- These Terms of Engagement must be read in conjunction with Be Comfy’s Privacy Policy.
2. Scope of Services:
- The agreement between the Consultant and the Client to provide Services refers to the specific Service booked by the Client on the Be Comfy's Booking Platform (https://bit.ly/3w5leW5) (Booking Platform).
- The scope of Services will be as per the Service Description in the Booking Platform or as further detailed and agreed to in any subsequent emails between the Consultant and the Client.
3. Appointment and Access:
- Where relevant to the booked service, the Client agrees to be available for contact by phone or by Teams meeting at the time of the booking.
- Where relevant to the booked service, the Client agrees to provide access to the Consultant for the purpose of conducting the home assessment at the agreed-upon date and time.
- If the Client needs to reschedule or cancel the appointment, they must notify the Consultant as early as practical, ideally within 48 hours of the scheduled appointment.
4. Payment:
- The Client agrees to pay the agreed-upon fee for the Services.
- Payment is due upon completion of the Service, in accordance with the Invoice terms.
- An invoice will be sent to the Client with the final report, usually within one week of the assessment, or as agreed with the Client.
- Additional fees may apply for any requested follow-up consultations or services beyond the scope of the initial agreed Service.
6. Confidentiality:
- Information gathered from the Client will be handled in accordance with Be Comfy’s Privacy Policy.
7. Limitation of Liability:
- The Consultant is not responsible for any damages or losses that may occur as a result of the recommendations provided in the energy assessment report.
8. Governing Law:
- This agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.
9. Digital Acceptance:
- By making a booking for the home energy assessment services through Be Comfy's Booking Platform (https://bit.ly/3w5leW5) the Client acknowledges and accepts the terms outlined in this agreement.
- The Client's digital acceptance, including the submission of the booking, shall be considered equivalent to a written signature.
10. Entire Agreement:
- This document constitutes the entire agreement between the parties and supersedes any prior discussions or agreements, whether oral or written.
